Consumer Health Data Privacy Policy

1. Overview

This Consumer Health Data Privacy Policy explains how Lothar Bielke Coaching LLC, United States ("we", "us"), handles consumer health data, as defined by the Washington My Health My Data Act and similar laws. It applies to the Performance Gap Check at gap-check.lotharbielke.com and supplements our Privacy Policy.

2. Categories of consumer health data we collect

• Information you choose to share: information about your energy, wellbeing, or health that you include in your answers to the Performance Gap Check or in an optional reflection before a conversation.
• Inferences: an internal review flag created by an AI service that indicates possible signs of serious distress, a health crisis, or a risk of harm.

3. Sources

• Directly from you, through the Performance Gap Check and the optional pre-conversation reflection.
• Derived from your answers by an AI service (Anthropic) acting on our behalf.

4. How we use consumer health data

• To create your personal reflection and send the follow-up notes you requested.
• To send you a short supportive note instead of the full reflection where there are signs of serious distress, and to allow us to review such cases personally.
• To prepare a conversation, if you request one.

5. Consent

We collect and process consumer health data only with your explicit consent, given in the Performance Gap Check. You may withdraw your consent at any time.

6. Sharing

We do not sell consumer health data and do not share it with third parties. It is processed only by service providers acting on our behalf under contract:

• Cloudflare: hosting and database of the Performance Gap Check.
• Anthropic: AI processing to create reflections and, where applicable, conversation preparation.
• Brevo: delivery of the email containing your reflection.

We have no affiliates that receive consumer health data.

7. Retention

Consumer health data is scheduled for deletion six months after your last activity in the Performance Gap Check, or earlier on request.

8. Your rights

You may request access to or deletion of your consumer health data, or withdraw your consent. We will respond within 45 days. If we decline your request, you may appeal by replying to our response.
